By engaging the services of Executive Warrior Academy, you acknowledge and agree:
* Health coaching is not a substitute for medical care, diagnosis, or treatment
* You must consult with your physician before starting any health, nutrition, or fitness program
* You will not discontinue or modify any prescribed medications or treatments without physician approval
* Executive Warrior Academy does not diagnose, treat, cure, or prevent any disease or medical condition
* If you experience any health symptoms or concerns, you will seek immediate medical attention
* Individual results vary significantly. Your outcome depends on numerous factors including but not limited to:
- Current health status and medical history
- Genetics and metabolism
- Adherence to program recommendations
- Lifestyle factors (sleep, stress, environment)

Emergency Situations: If you experience a medical emergency, call your local emergency services immediately. Do not rely on health coaching services for emergency medical needs.
No Guarantees: Executive Warrior Academy makes NO guarantees regarding:

* Energy levels or cognitive function improvements
* Reversal of health conditions
* Specific performance outcomes
* Timeline for results
Testimonials and case studies represent individual experiences and are not typical results. Your results may be better, worse, or non-existent.
CLIENT RESPONSIBILITIES & INFORMED CONSENT
By engaging Executive Warrior Academy services, you represent and warrant:
* You are at least 18 years of age
* You have disclosed all relevant health conditions, medications, allergies, and medical history
* You will immediately notify us of any changes to your health status
* You understand health coaching is not medical care
* You have consulted (or will consult) your physician before starting any program
* You will follow your physician's recommendations if they conflict with coaching advice
* You assume full responsibility for your health decisions and actions
* You are physically and mentally capable of participating in recommended activities
You agree to:
* Provide accurate and complete health information
* Inform your coach of any adverse reactions or concerns
* Stop any activity that causes pain or discomfort
* Maintain regular communication with your healthcare providers
* Take full responsibility for implementing (or not implementing) any suggestions
SCOPE OF PRACTICE
What Health Coaching IS:
* Personalized guidance on nutrition, lifestyle, and wellness strategies
* Education on biohacking and functional approaches to health
* Support and accountability for behavior change
* Goal-setting and action planning
* Evidence-based recommendations for optimization
What Health Coaching IS NOT:
* Medical diagnosis, treatment, or prescription
* Psychotherapy or mental health treatment
* Nutritional therapy for medical conditions (without physician oversight)
* Emergency medical services
* A replacement for licensed healthcare providers
Executive Warrior Academy works collaboratively with your healthcare team and encourages you to maintain relationships with licensed medical professionals.
PAYMENT, CANCELLATION & REFUND POLICY
Payment Terms:
* Fees are due as agreed upon enrollment
* Prices subject to change; current clients locked in at enrollment rate for duration of program
* Failed payments may result in service suspension
Cancellation Policy:
* 30 days written notice required
* Cancellation must be submitted in writing to via support form at Support - Executive Warrior Academy
* No refunds for partially completed programs
* Unused sessions do not roll over or carry monetary value
Refund Policy:
* Refund is subject to discretion of Executive Warrior Academy. This discretion does not limit your rights under Australian Consumer Law.
* All Refund Request must be submitted in writing via support form at Support - Executive Warrior Academy
* If Executive Warrior Academy approves refund request, refunds are processed within 14 business days.
* Refunds are issued to original payment method
Chargebacks: Initiating a chargeback without first attempting to resolve the issue directly may result in immediate termination of services and legal action to recover costs.
LIMITATION OF LIABILITY
Australian Consumer Law Guarantees
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (ACL) or other applicable law that cannot lawfully be excluded, restricted, or modified.
Under the Australian Consumer Law, you have certain guaranteed rights in relation to the services we provide, including that services will be:
* Provided with due care and skill
* Fit for any purpose you make known to us
* Delivered within a reasonable time (where no time is specified)
Limitation of Liability (To the Extent Permitted by Law)
To the maximum extent permitted by law, and subject to the Australian Consumer Law:
Executive Warrior Academy (Spiritual Family Trust trading as Executive Warrior Academy), its trustees, employees, contractors, and agents will not be liable for any:
(i) Incidental, consequential, indirect, or special damages (including but not limited to loss of profits, business interruption, loss of data or information, loss of opportunity, or personal injury) arising from:
* Use of or inability to use our website, mobile applications, or services
* Any information, content, or transactions provided through our services
* Any errors, omissions, or inaccuracies in our services or materials
* Any delay or interruption of services
(ii) Claims arising from circumstances beyond our reasonable control
This limitation applies even if we have been advised of the possibility of such damages.
Maximum Liability Cap
Where liability cannot be excluded but can be limited (for non-major failures under the ACL), our total liability to you for any claim is limited to, at our option:
* Re-supplying the services, or
* Payment of the cost of having the services re-supplied, or
* Refunding the amount you paid for the services in the 12 months preceding the claim
Major Failures
The above limitations do not apply to major failures under the ACL. A major failure occurs when:
* Services are substantially unfit for their common purpose and cannot easily be remedied
* Services are substantially unfit for a purpose you made known to us and cannot easily be remedied
* Services are substantially different from what we described or demonstrated
* Services are unsafe
In the case of a major failure, you are entitled to cancel your service contract and obtain a refund, or to obtain compensation for any reduction in value.
Your Acknowledgment
By using our services, you acknowledge that:
* Our website and applications may contain inaccuracies or typographical errors
* We make no warranty that our website or applications will operate error-free or be free from viruses or harmful components
* Use of our website, applications, and services is at your own risk
* We may make changes to our website and applications at any time without notice
* If your use of our services results in the need to service or replace equipment or data, we are not responsible for those costs (except where required by ACL)
Indemnification.
You agree to indemnify, defend and hold harmless, Executive Warrior Academy (Spiritual Family Trust), its members, officers, directors, employees, agents, licensors, suppliers and any third party information providers to our website, and mobile applications, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any use of our website or violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing our website.
Third Party Rights.
The provisions of paragraphs (Use of Products and Services), and (Indemnification) are for the benefit of our website and its owners, officers, directors, employees, agents, licensors, suppliers, and any third party information providers to the Service. Each of these individuals or entities shall have the right to assert and enforce those provisions directly against you on its/their own behalf.
Waiver
Our failure to enforce any provision of these Terms of Service and Conditions of Use shall not be deemed a waiver of the provision nor of the right to enforce the provision.
Our rights under these Terms of Service and Conditions of Use shall survive any termination of this agreement.

INTELLECTUAL PROPERTY
Ownership of Materials
All content, materials, courses, programs, protocols, videos, worksheets, templates, documents, and other intellectual property provided by Executive Warrior Academy (Spiritual Family Trust) are protected by Australian copyright law and remain the exclusive property of Executive Warrior Academy.
Your License to Use Materials
Upon enrollment, you receive a limited, non-exclusive, non-transferable, revocable license to access and use our materials solely for your personal, non-commercial use during your active enrollment period.
You agree NOT to:
* Reproduce, copy, or duplicate any materials without written permission
* Distribute, share, or transmit materials to third parties
* Modify, adapt, or create derivative works from our materials
* Use materials for commercial purposes or resale
* Remove copyright notices or proprietary markings
* Record coaching sessions without prior written consent
* Claim authorship or ownership of our materials
* Post materials on social media, websites, or public forums
License Termination
Your license to use materials terminates immediately upon:
* Completion or cancellation of your program
* Breach of these Terms
* Termination of your enrollment for any reason
Upon termination, you must delete or destroy all copies of materials in your possession.
Feedback & Ideas
If you provide feedback, suggestions, or ideas to Executive Warrior Academy, you grant us an unlimited, perpetual, royalty-free license to use such feedback without compensation or attribution.
ASSUMPTION OF RISK
Health Coaching Carries Inherent Risks.
You acknowledge and understand that participation in health coaching services, biohacking protocols, functional medicine approaches, nutritional guidance, lifestyle modifications, and physical activity recommendations carries inherent risks.
Potential Risks Include (But Are Not Limited To):
* Physical injury or strain from recommended exercises or activities
* Adverse reactions to dietary changes or nutritional supplements
* Metabolic changes or hormonal fluctuations
* Exacerbation of pre-existing medical conditions
* Allergic reactions or food sensitivities
* Changes in blood glucose, ketone levels, or other biomarkers
* Digestive discomfort or changes in bowel function
* Sleep disturbances during adaptation periods
* Temporary decreases in energy or performance during transitions
* Interaction between recommendations and prescribed medications
* Psychological or emotional responses to lifestyle changes
* Unpredictable individual responses to protocols
Your Voluntary Assumption of Risk
By engaging Executive Warrior Academy services, you:
* Voluntarily assume all risks associated with health coaching and implementation of recommendations
* Acknowledge that you have been advised to consult with your physician before starting any program
* Understand that biohacking and functional approaches may not be suitable for everyone
* Accept that individual results are unpredictable and cannot be guaranteed
* Agree that Executive Warrior Academy is not liable for adverse outcomes resulting from your choices to implement (or not implement) recommendations
* Recognize that you are solely responsible for monitoring your own health status
* Commit to immediately seeking medical attention if you experience concerning symptoms
Special Considerations
You must immediately inform your coach and seek medical advice if you:
* Experience chest pain, severe shortness of breath, or dizziness
* Notice unusual symptoms or adverse reactions
* Become pregnant or are planning pregnancy
* Are diagnosed with a new medical condition
* Begin taking new medications
* Experience significant changes in health status
Your Responsibility
You are ultimately responsible for:
* All health decisions and actions you take
* Determining whether recommendations are appropriate for your individual circumstances
* Monitoring your own response to protocols
* Maintaining communication with licensed healthcare providers
* Stopping any activity that causes pain, discomfort, or concern
Release of Liability
To the maximum extent permitted by law (and subject to Australian Consumer Law), you release Executive Warrior Academy, its trustees, employees, and contractors from liability for any injury, illness, or adverse outcome resulting from your voluntary participation in coaching services or implementation of recommendations.
GOVERNING LAW & JURISDICTION
Applicable Law
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
Jurisdiction
You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of New South Wales, Australia, and any courts which may hear appeals from those courts, for any legal action or proceeding arising out of or in connection with these Terms or the services provided.
International Users
If you access our services from outside Australia, you are responsible for compliance with local laws in your jurisdiction. These Terms remain governed by Australian law regardless of your location.
DISPUTE RESOLUTION
Good Faith Negotiation
Before initiating any formal dispute resolution process, both parties agree to attempt to resolve any dispute through good faith negotiation.
Notice of Dispute
If you have a dispute, you must first provide written notice to Executive Warrior Academy via our support form at ExecutiveWarriorAcademy.com/support, including:
* Description of the dispute
* Desired resolution
* Any relevant documentation
We will respond within 14 business days and attempt to resolve the matter amicably.
Mediation (Optional)
If negotiation fails, either party may request mediation through a mutually agreed mediator or mediation service in Sydney, New South Wales. The costs of mediation shall be shared equally unless otherwise agreed.
Legal Action
If mediation fails or is declined, either party may commence legal proceedings in accordance with the Governing Law & Jurisdiction clause above.
Continued Service During Disputes
Unless otherwise agreed in writing, you must continue to meet your payment obligations during any dispute resolution process. Refunds, if applicable, will be determined as part of the dispute resolution outcome.
Class Action Waiver
To the maximum extent permitted by Australian law, you agree to bring any dispute on an individual basis only and not as part of a class action, consolidated action, or representative proceeding.
SEVERABILITY
Invalid Provisions
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction:
* That provision shall be deemed severed from these Terms
* The remaining provisions shall continue in full force and effect
* The invalid provision shall be replaced with a valid provision that most closely approximates the intent and economic effect of the invalid provision
Partial Invalidity
If only part of a provision is invalid or unenforceable, the remainder of that provision and all other provisions shall remain valid and enforceable.
Australian Consumer Law Protection
Nothing in this severability clause affects the operation of the Australian Consumer Law or other mandatory consumer protections that cannot be excluded by agreement.
ENTIRE AGREEMENT
Complete Understanding
These Terms and Conditions, together with our Privacy Policy, constitute the entire agreement between you and Executive Warrior Academy regarding the use of our services and supersede all prior or contemporaneous:
* Oral or written communications
* Proposals or agreements
* Representations or understandings
* Marketing materials or promotional content
No Reliance on External Statements
You acknowledge that you have not relied on any statement, representation, warranty, or understanding that is not expressly set out in these Terms, except to the extent such reliance cannot be excluded under Australian Consumer Law.
Conflicts Between Documents
In the event of any conflict between these Terms and any other document:
* These Terms shall prevail to the extent of the inconsistency
Unless the other document expressly states it overrides these Terms
Australian Consumer Law protections always take precedence
Written Agreement Required
Any variation, amendment, or waiver of these Terms must be in writing and signed by an authorized representative of Executive Warrior Academy to be valid.
MODIFICATIONS & UPDATES
Right to Modify
Executive Warrior Academy reserves the right to modify, amend, or update these Terms at any time at our sole discretion.
Notice of Changes
When we make material changes to these Terms, we will:

* Notify you via email to your registered email address (if you are an active client)
* Post a notice on our website for at least 30 days
Minor Changes
For minor, non-material changes (such as typographical corrections or clarifications that do not affect your rights), we may update these Terms without prior notice.
Acceptance of Changes
By continuing to use our services after changes become effective, you accept and agree to the modified Terms. If you do not agree to the changes:
You must discontinue use of our services
You may cancel your enrollment in accordance with the Cancellation Policy
Cancellation rights under Australian Consumer Law still apply
Version Control
We maintain previous versions of these Terms for reference. You may request a copy of prior versions by contacting us through our support form.
Current Clients Protected
If you are enrolled in a program at the time of a material change:
The version of Terms in effect at your enrollment date will generally continue to apply for the duration of your current program
Except where changes are required by law or necessary to protect the safety and security of our services
Price protection as stated in Payment Terms remains in effect
